Information we collect through forms
When you request a Move Math Plan or otherwise contact us, we collect the information you choose to give us: your name, email address, telephone number, the city of the property you are asking about, and what you are considering (for example selling, buying, or a keep-or-sell question). We do not require sensitive information such as a Social Security number or financial account number to submit a form.
Email, telephone and text message information
If you contact us, or ask us to contact you, we keep a record of that correspondence, including emails, call notes, voicemails and text messages, so we can respond and maintain continuity on your matter. By submitting a form you agree that we may contact you about your inquiry by phone, email or text. Message and data rates may apply. Consent is not a condition of purchasing services, and you can ask us to stop contacting you at any time by replying STOP to a text, or by calling or emailing us.
Property and transaction information
You may voluntarily send us property details, loan and payoff figures, tax basis information, lease or tenancy details, inspection reports and similar documents so we can prepare an analysis or represent you in a transaction. We use that information for that purpose and for the recordkeeping a licensed brokerage is required to maintain.
Analytics, cookies and technical information
Like most websites, ours may receive basic technical information automatically, including IP address, browser and device type, referring page, and pages viewed. This may be collected using cookies or similar technologies, including those used by analytics or hosting providers, to keep the site working and to understand which pages are useful. Most browsers let you block or delete cookies; the site should still work if you do.
How we use information
We use information to respond to your inquiry, prepare the written analysis you requested, provide brokerage and property management services, meet legal and recordkeeping obligations, maintain and improve the website, and send you follow-up about your inquiry or your transaction.
Service providers and CRM systems
We use trusted service providers to operate our business, including a customer relationship management (CRM) system that stores inquiries and correspondence, plus email, telephone, e-signature, website hosting and analytics providers. These providers may process your information only to provide services to us. In a transaction, information may also be shared with the parties and professionals required to complete it, such as escrow, title, lenders, transaction coordinators, cooperating brokers and inspectors.
When information may be disclosed
We may disclose information when you direct us to, to the service providers and transaction participants described above, when required by law, court order, subpoena, or regulatory or licensing authority, to enforce our agreements, or to protect the rights, property or safety of our clients, our company or the public.
We do not sell personal information
We do not sell your personal information, and we do not rent or trade your contact information to unrelated third parties for their own marketing.
Data retention
We keep inquiry and transaction records for as long as needed to serve you and to satisfy the recordkeeping, tax and legal requirements that apply to a California brokerage, and then dispose of them in a reasonable manner. If you ask us to delete your information, we will do so except where we are required to retain it.
Security
We use reasonable administrative and technical safeguards to protect the information we hold, including access controls and encrypted transmission of form submissions. No website or system can be guaranteed completely secure, so please do not send highly sensitive information by unencrypted email.
California privacy rights
Where applicable California law gives you rights, you may request to know the categories and specific pieces of personal information we have collected about you, request deletion or correction of that information, and not be discriminated against for exercising those rights. To make a request, email powerbroker@themontenegrogroup.com or call (858) 434-8008. We may need to verify your identity before responding, and some information must be retained where law requires it.
Children's privacy
This website is intended for adults. We do not knowingly collect personal information from children under 13. If you believe a child has provided information to us, contact us and we will delete it.
Third-party links
Our site links to third-party resources, such as the California Department of Real Estate license lookup and our review profiles. Those sites are governed by their own privacy policies and practices, and we are not responsible for their content or their handling of your information.
